Interior Department Says Not Bound By Court Decision

The US Department of Interior says it is not bound by a
Federal court ruling that the Shinnecock Indian Nation
are a federally recognized tribe.

The statement by James Cason, associate deputy
interior secretary, and quoted in Newsday, came in
response to a letter to Secretary of Interior Gale
Norton by Senator Chuck Schumer. Schumer urged the
department to disregard the Court's decision.

In the Federal Court decision of November 7, 2005
judge Thomas Platt of the 2nd circuit ruled that the
Shinnecock did not need Bureau of Indian Affairs recognition.

Judge Platt wrote that since the Federal government
opted out of the case brought by New York State and Southampton
Town,

"one may conclude that the United States is
disclaiming any interest in the question and accepts the status of the
Defendants as an Indian Tribe."

But the Interior department said it's not bound by the
ruling because it is no longer a party in the case.

The Federal recognition process begun in 1978 is
expected to take many years.

The question of whether the Shinnecock can build a
casino on their West Woods property in Hampton Bays
must go to court as ruled by Judge Platt. West Woods
located west of the Shinnecock Canal is not a
contiguous part of the Reservation which is east of
the canal.

Letter Calls for Condemnation of Racist Attack on Shinnecock

Updated Jan 6

The following letter was sent to the Southampton Press:

January 6, 2006

To the editor:

Our elected officials who came out immediately and fiercely against the aspirations of the Shinnecock Indian Nation should now come out as fiercely to condemn the racist attack on the Shinnecock property at West Woods.

The attack, with graffiti that included a representation of a lynching, was the reply of racists to the recent Federal court judgment recognizing the Shinnecock as a sovereign nation.

This is part of a campaign of intimidation reminiscent of what occurred in the American South after African-Americans started to assert their rights in court and exercise their right to vote. The symbols and words used in the graffiti show the direct, undeniable connection to that racism.

Governor George Pataki, Congressman Tim Bishop, Senator Charles Schumer, Senator Hillary Clinton, Assemblyman Fred Thiele, Legislator Jay Schneiderman, Southampton Supervisor Patrick Heaney and others have united in opposition to the Shinnecock. They have used their influence and power to wage a legal and propaganda war against the tribe.

The attack occurred because the perpetrator believed he had tacit approval to carry out the will of the community.

People may have honest differences concerning a casino, but this blatant racism is far beyond that. Our elected officials and all of us should unite to declare that the Shinnecock are to be respected as a sovereign people and that racist attacks will not be tolerated here.

Peace Activists Will Urge Congressman to Call for Troop Withdrawal

Peace activists have another chance to dialog with Congressman Tim Bishop next Monday in Southampton. The congressman will discuss local and national issues and take questions from the audience at the Rogers Memorial Library on Windmill Lane in Southampton on Monday, January 9 starting at 7pm.

At a meeting last month in Sag Harbor Congressman Bishop said he was considering supporting a congressional resolution calling for prompt US withdrawal from Iraq, but he was "not there yet".

Local peace activists are expected to once again urge Mr. Bishop to call for withdrawing our troops by co-sponsoring a resolution which has been introduced in Congress.

House Joint Resolution 73 – to Re-deploy U.S. Forces from Iraq Introduced by Rep. John Murtha (D-PA) calls for the immediate end to the deployment of U.S. troops in Iraq and declares that the US shall pursue security and stability in Iraq through diplomacy. The resolution also calls for an “over the horizon” presence of the marines in the region. For details and a list of co-sponsors:
